Can a owner/operator legally run under the 8/70 hour rule if they take 34 hour resets instead of running on recaps? Technically that’s a day without a truck on the road…?

When I was company, I ran hard. They would send me to Hazleton, PA from Mcallen, TX, get reloaded, and back down I would come. About 3800 miles and I would do it in 6 days and be within a few hours of my 70. 34 at home and leave on day 8 with a fresh 70 and do it all over again.
They didn’t like you to roll your clock. Dispatchers didn’t like math.
When they would send us to Seattle, WA, they wanted you to get there on day 4 and reset there before catching a reload home. I hated resetting on the road, and it took talking to 3 different people there to convince them to let me roll my clock and I could back on the same day as if I resetted, and not be nearly as tired.
As far as I know, I was the only one that rolled my clock at that company lol.
So yeah, it doesn’t matter if you roll your clock, reset, or do a combination of both. There’s no real advantage as far as how many miles you can do in a weekly average. UNLESS…you are trying to be Captain Efficiency on a drop and hook account and can handle a screwed up sleep schedule. Then running a tight clock and using your 34 can theoretically earn you more miles.
But #### all that noise.

If you're with a company that parks the trucks one day a week. You're on the 60 hour rule.
Local work for instance. Usually takes Sunday off.
Companies that roll 8 days are on the 70 hour rule.Keepforgettingmypassword and 77fib77 Thank this. -
or
on-duty/driving for 11 hours and 40 minutes per day (max 11 hrs driving) for 6 days and then get a 34 hour Reset
or
on-duty/driving for 10 hours per day for 7 days and then get a 34 hour Reset
or
on-duty/driving for 8 hours 45 minutes everyday and never get a reset.
IMO, the 70 hrs/8days for owner operators is just BS. never understood why owner operators are bunch together with company drivers for HOS
if a owner operator is onduty/driving for 14 hrs and then getting his 10 hrs break, then why can't O/O do this 14/10 for infinite times.
the whole HOS is to ensure the drivers are rested properly before resuming their duties again.

If OP is available to operate 7 days a week he is 70 in 8 and could work thru a weekend. A company could have 30 drivers off all weekend but just one coming in on saturday and one leaving on sunday, as is common at a lot of places, would be 70 in 8.
As stated above the HOS is supposed to isure rest between shifts.
The 34 hour reset pays off for the carrier.
Under the old regulations five days of 14 hours [14 x 5 = 70] leaves the driver with zero hours the next Monday.
With the reset, working 14 hrs a day with 34 off over the weekend and you get your whole 70 to do it all over again...
Carriers get more from fewer drivers and still meet HOS winner, winner, chicken dinner for them.
Instead of spreading that 70 over 8 days, you now do it in 5, over and over and over.....But the DOT feels this is safer because they sold he public on the 10 off instead of the old 8
