Owner Operator: required to be enrolled in a drug testing program?

    I am an owner operator but I put my business in non operating status right now.

    Is it a requirement to be enrolled in a drug testing program to have my CDL?

    Or is the only time you need to be enrolled in a drug testing program is when your working for a trucking company or when your an O/O?

    Your employer is required to have you in a drug testing program . If you are leased to a carrier it's their responsibility .
    If you are an O/O with active authority you are your own employee and have to follow all the requirements of an employer including having a driver file , etc .
    Even though you are nonoperating right now I'd stay in a program if you were in one and keep the file active (annual driver violation reports , etc.) just to avoid explaining the lapse later .

    Unless you suspend your authority with the FMCSA, you MUST have a Drug/Alcohol testing program in place.
    You can be fined heavily for not having that and of course be officially placed out of service.

    Look at OOIDA for only $100/yr for this or consider officially suspending your authority.

    When you file your MC, you agree to have a Drug/Alcohol testing program IN PLACE within 21 days.
    (Its on the application...)

    PS. If your authority is active and you haven't had your New Entry Audit yet...and it comes your time - you will be in serious trouble with the DOT if she visits you and you have no program in place. You do not want anything bad (ever!) on your MC...

    WRONG.....They give you 30 days to bring it into compliance after the audit. Just have to FAX them the enrollment info. Been there done that.

    Instead of using ooida check with your local clinic, they typically have these programs available for half the money.
