Owner operator STILL waiting on payment???

    First thing i would do is talk to the shippers that you did the run for to see if it has been paid if not you have all the paper work and PODs give them the bill and take the customers
    I would also tell them if they settle with you in the next week you will take a % off what they owe you
    Also you need to file on there bond most people when you say this they cut a check fast

    I had a company get me for $18,000 never never never will i let someone get that far into my pocket 30 days is all get people do have problems time to time i get it.
    One of my customers was not doing good they lost a big job i just told them pay me 40% now and i would let the 60% go for 160 days now they run the ##### out of me and never b!tch about my price

    My husband was hired as the trucking manager for this company because of this our trucks ran under their authority and we submitted our trucks invoices to them and they turned our invoices in with their trucks. There wasn't a true lease, so to speak.
    It was more of a handshake...

    If someone else was present at the time of the deal and is willing to go to court stating what you are entitled to,you can win your case on a verbal contract.I won a law suit this way,you just have to make sure you have your ducks in a row and be willing to push it.

    Small claims court can help. Not sure what the laws are there but you can also put a lien on their property for unpaid monies.

    Also, have you ever watched the Sopranos? Just a thought.

    File on the bond for the full amount they owe you. Sounds like you are waaaay past the point of being nice and giving them a second chance.

    You were not leased to them, you didn't have a written lease. You cannot run under someones authority without a written lease containing specific things. It is the law, basically you were running illegal. How big of a can of worms are you willing to open?

    If you take them to court,you are not on trial.They are,so it does not matter what if any laws you broke.

    File a lien against some of the equipment that you were involved in hauling, or also on oil leases etc. You'll get their attention then.
