Owner/Ops running for two MC's

    I think I'm posting in the correct forum, ha. If not admin please move.

    Ive seen some posting similar to this topic, but not specifically to my situation, so going to ask.

    I'm a new LLC, have DOT under my own name, in process of getting MC#. I do not have my own truck (as of yet). I have a relative that is a lease-on with another MC, he does have down time, the question is can he also run under my MC (to be) as well to get the ball rolling on my MC?

    I understand I will need to insurance his truck full time, as his truck in also insured under the other MC he works for. Plates? Not fully understanding the plate requirement, would he need to have two different plates if the other MC owns the plate? If he own his own plates, then no? He does own his own truck out right. I am in the State of Ohio.

    So the thought is, he runs with his current employer (1099), he does have their DOT/MC on his truck, when he is slow I will give him loads to run, possibly create a magnet sign to cover the name of the other MC's information and display mine, then 1099 him as well.

    What MC are you getting broker or common carrier?
    Why not run the loads using the ,1099 mc. Make agreement with them.

    I think both companies would need to add and drop the truck for IRP each time. You can't have 2 plates active for the same truck.

    Why not just buy a junk truck, license and insure it to hold your MC open while you do whatever else you want to do with it?

    I thought about that, I just don't want to buy a bad truck and put someone in it. I rather buy a new, run the MC to cover costs (I do have a day job) and then when I'm ready to move forward I will have a nice truck mostly if not all paid for. I will need to generate about $9k in revenue a month to cover cost of a new 389, new F/SD, insurance, some extra money, pay the driver, etc etc. I will not draw a salary and run as a s-corp saving on taxes, write off the truck/trailer, etc.. Will help get it off the ground. Then when I want to get behind the wheel, no truck payment on a low mile nice truck/trailer. At least what I'm thinking, ha!

    You have pointed out 1 issue, the plates.

    here are a few more, leased onto another MC, that truck has their eld and it will register the movements when logged out.

    that first lease has a section about working for another mc at the same time, could be in breach of contract.

    ifta, would be extremely difficult.

    you are creating a catastrophic court case in the event your truck is invoked in an accident. You are theoretically running 2 logs which is illegal as hell, on top of that your creating a perfect situation for insurance companies to Denise coverage because you have 2 and the other one will cover it… leaving neither to actually cover it and good luck explains this brainchild in court to people that don’t know the industry, they would assume you were up to some nefarious ####.

    you are better off jumping in head first or sitting on the dock…
