What this means is rather than show up early and maybe get unloaded before appointment time I will stay away and do my break before I even arrive. It was my misunderstanding that if you spent ANY time driving while on customer property it will be recorded as line 3 and possibly later a violation for driving past your 14 hour window. So basicly, hos limits driving time even if you are not on any public road ways, which if inspected later you could get a violation. Hos also only restricts driving time, and if you are a yard driver, never leaving the property, at one company and work for 12 hours *all on line 3* then proceed to your other job and are inspected you are guilty for violating the Hos, because you went over your 11 hour limit, even though you took a 10 hour break afterwards and also never entered a public road while the violation occurred. A yard jockey, if that's all they did, would be on timecard rules. If they split time on and off the road in a way that necessitated rods (100+ miles, more than 8 out of 30 days), then in THAT situation, all time jockeying would be line 3.
I posted that guidance as an illustration of my point that DOT considers all time at the wheel of a commercial motor vehicle to be 'on duty, driving'(line 3) not 'on duty, not driving'(line 4) irrespective of geographical location.gokiddogo Thanks this. -

That distinction combined with a speed trigger and no distance trigger for the drive line is why companies like UPS are requesting an exception from part or all of the mandate. Since their drivers are their own jockeys, hooking up doubles is going to be a pita. Multiple switches between line 3 and 4 in a short amount of time plus trying to keep the computer straightened out on what's what will be a headache.

It does not matter if private or public property. If you are logged into the ELD it will trigger line 3 <5 MPH. Your best bet is if you use your tractor for local yard work, then log off the ELD, do the yard work, then when logged in again, do not accept the mile difference. BUT, notify your company so they can note the mileage difference and not charge it back to you.
