    When did they add this 50 mile rule to PC? I think most people would agree with you on the whole grocery bag of spare drivers to run coast to coast and back again in a week not being a good thing, but hey nobody parked on the shoulder right?

    No, there is not a 50 mile rule in place.
    Here is the list: List of Proper Use of Personal Conveyance
    Not a single one has a mile restriction. Canada has a 75km restriction, which comes out to 46.6 miles....

    The best match from your scenario is simply "closest safe location" Note it doesn't say closest in the direction of load...

    3. Time spent traveling to a nearby, reasonable, safe location to obtain required rest after loading or unloading. The time driving under personal conveyance must allow the driver adequate time to obtain the required rest in accordance with minimum off-duty periods under 49 CFR 395.3(a)(1) (property-carrying vehicles) or 395.5(a) (passenger-carrying vehicles) before returning to on-duty driving, and the resting location must be the first such location reasonably available.

    Last night I had to drive 1 hour on pc to find a spot all 5 truck stops full.

    Might get a ticket if audited but #### that, safety first. I’m new and even I know parking on shoulder is no good. Rest areas, closed down weigh stations and check points are all game.


    The family is going through hell, but the driver although shouldn’t be at fault as it could have been a broken down vehicle or even a bridge.

    We can’t fix stupid but being a ”professional” driver we should take that into account when we calculate everything.

    Bull crap. It will be partly your fault, yes but there will be culpability elsewhere and you and your lawyer will be doing the same thing everyone else does in that situation [where the vehicle was drivable and did not have to stop on the immediate shoulder], and rightfully so. Don't tell us that. We know better.

    HOS rules would render vehicle inoperable as the pilot is no longer allowed to captain his ship per gooberment rules, so one can argue vehicle is disabled.

    It’s going to be a tough on on this as it can have ramifications that will ripple through the industry. As it will bring the HOS to a point of being revised.

    I would say the back of a semi trailer disapates energy better than a concrete barrier or say a tree or any other number of objects along the side of a highway ramp.
    Heck I have seen in construction zones at night where there are bulldozers,excavators and other heavy equipment that were left along the edge of a ramp that is being repaired after there day was done.
    The fact remains if YOU illegally leave your lane and run off the highway it’s YOUR responsibility.
    Weather you hit an immovable object or a field of marshmallows is irrelevant.

    On the shoulder and just around a corner. Probably didn't have lights on either.

    Not going to get into the wisdom of parking on the shoulder but if one feels they must then being as visible as possible should be a priority.
