@DillonJ check out Tyson Foods. Its reefer and they do train you. You will be out with a trainer somewhere around 6 weeks as long as got got your cdl from an accredited school. Also ask about reimbursement for school. They have a texas regional but not sure if they would be able to put you on it right after training. I am on it. I leave the house Sunday and get back Friday. We are always around ft worth area so you may be able to take a 10 at the house during the week as well

have never seen that on an application. if I did I would leave.

negligence does NOT mean purposely doing something. see below.

    neg·li·gence
    /ˈneɡləjəns/

    Learn to pronounce

    noun
    noun: negligence; plural noun: negligences
failure to take proper care in doing something.
"some of these accidents are due to negligence"

Or it's to try and make a new employee understand that when they abandon the truck in Timbuktu with a load of dog crap in it and no keys, it's coming out of their pay.

And you know what? They still do it. I just had to retrieve one like that last week. Cost the company far more than what that list would cover, cost me a very long day waiting for a locksmith.

@Oor that is the risk you take when you hire someone. Then you run across a good person like me who will tell you take a long walk on a short stick. Anyone who signs that does not have the means to pay you anything if they hit something major. That is why you have insurance. There is no justification for this kind of stipulation. A person who signs it has no means of paying any of it and the one who does will not sign it. IT IS JUST STUPID AND FRAUD.

You know what, they were all good people just like you. Then they weren't. Odd that. It's not like anybody sets out to hire a retard. It's not like us express started with this list. Imagine how many times they've been screwed to reach this point.

Illegal everywhere, just some jurisdictions have stronger employee protection laws than others, as stated above, just google your laws where you live. But DO NOT sign any agreement stating you, as an employee, are responsible, and agree to any possible deductions. If you do, you are opening up a can of worms, even if it is clearly illegal where you live...

@3onses why would I want to work with these frauds? F*** them. I called them this morning and they said, unfortunately, we can not change that. I was like thank you for your time but I am not your insurance company best wishes.

I have an interview for a local job in couple of hours and another one tomorrow. I might a little emotional after hitting so many fraud trucking companies in my short career. But I am of the opinion working for a trucking company is a fools errand. I have not been able to bring myself to even call a single trucking company in my job search today. None of my interviews are with a company whose primary business is trucking.

In this context of labor law in most states negligence is determined by a judicial proceeding, not by the opinion of the employee or the employer.

Under federal rules hourly workers they have to:

    1) Sign an agreement like this
    2) Deductions do not reduce their wages below minimum wage + overtime.

The unanswered question on #2 is that the MC exemption untested although these types of deductions are not legal for employees under the salary rule exemption.

If a driver was from say Washington State with a $12 minimum wage or lets say from Wyoming which only allows damage deductions due to court action....I would be a bit nervous as a company owner to make these deductions.

In my home state, which is the law that matters when you are an interstate driver, It appears could file a wage dispute for any damages withheld and have a good chance of being successful even with a signed agreement unless they got approved for the specific incident.

While I can understand the frustration on both sides the truck systems and debt bondage schemes of the US West captured in the song "Sixteen Tons" probably means these agreements aren't enforceable in most states.

In theory the driver could win treble damages and legal fees it seems like that would be pretty high risk as a MC to really push this. While state overtime law does not protect drivers, payroll laws do apply. I don't feel sorry for the trucking companies because this is what you get when you choose to base your business on high turnover.
