PBJ for DUI

    I am currently in school for my CDL and will finish at the end of May. I have a probation before judgement for a dui. This is not a conviction under
    Maryland law however, it can not be expunged. It does not show up on my driving record because it's not a conviction however, it does show up on background criminal checks. So I have two questions; (1) Do companies look at both documents for employment? (2) Does the federal safety regulations consider PBJ's to be convictions?

    Any input would be helpful.

    If it shows up on a background the company will see it...saying that...there is plenty of companies that hire ppl with previous duis

    Companies will find out through their background check, guaranteed. I don't know the difference between standard conviction and probation before judgement, but I would assume that trucking companies will see it as one and the same.

    Is probation before judgement essentially deferred adjudication? You enter a guilty plea, complete probation, and the conviction disappears?
    Key point is age of violation, and how long you've been off probation.

    Yes a PBJ is a vacated adjudication and its my understanding it stays that way unless you have another violation within x number of yrs.

    In which case it then changes from a PBJ disposition to a guilty.

    Companies do look at both documents. The MVR (driving record) is the most important. Many companies don't give much weight to criminal records and some do.
    Does the PBJ mean you can possible be found guilty of a DUI at a later date?

    I think I am far enough past the probation period that it will stay a PBJ but, I do think if I was charged with the same offense they can go back and change it to guilty.
