PC and log violations

    How did he break the law? The FMCSA updated the rules last year allowing drivers to use PC to find a safe place to take their break, regardless if they are laden or not.

    The FMCSA has a means online to dispute citations and random violations you don't agree with. If you log into your FMCSA account, it's called DataQ, and you can lay it all out there for them to review.

    First of all please lets back up a minute. I am not speaking to the vast majority of cases where a great well informed cop is doing ti. I am talking about that jerk cop that every one of us have had the misfortune to come across. My point was getting those inspections with violations removed is not a snap. Also, how many drivers can go back to court to defend themselves? Some yes I agree. I'm just laying out worse case situations here not what to expect everyday. I have seen this nasty side of MCSAP many times. It stinks and it can't be made gone by a snap of the fingers especally if the driver is found guilty or forced by the situation to just pay a fine and plea it out. that is all i am saying.

    In the actual sense I agree with you on this. I have also stated many times this situation with HOS stinks the way the FMCSA has done it. Leaves that grey area that some jerk cops love to lpay in.

    Because if they didn't call and check on every little instance of PC drive time, some billy bigrigger in a crete truck would be abusing it and adding an extra 100 miles of PC driving every day. As long as you use PC time for what its intended for you shouldn't have any problem explaining why you've used it.

    They didn’t update the rules, they issued guidance about using PC to find parking. There is a huge difference between the two, and it leaves it up to the officer looking at your logs as to how he wants to interpret it.

    As for me, I went over. I wasn’t going to stop on a 2 lane road and switch to off duty PC just to get to the shop to park. I figured that nobody would give me flack about 8 minutes and I was wrong. Lesson learned.

    The guidance specifically states the only two uses for a safe location.
    1. After getting detained at a shipper/reciever and 2 at the direction of an LEO.
    Going from one truck stop to another does not count.

    As fot dataq, sure it's there. Thr problem is it goes back to the same place for review. Very unlikely the the officers supervisor will reverse it. It's possible yes, but not probable unless there is a dismissed court case.

    I like being treated like a man.
    I won't be questioned like a kindergartner over some safety sensitive issues like getting THEIR equipment fixed and then having no place to park.
    If you don't have PC.. drive to the FIRST place you can legally park and NOTATE NOTATE NOTATE why you did it.
    Have a copy of your repair bill to show a LEO in case you get checked.
    Take a full 10 when you get parked.

    If your company gives you crap about it... tell them to pound sand.

    YOU drive that truck. Not the snot nosed college boy that does watermelon jello shots with 19yo girls on Saturday while you're braving a blizzard in Wyoming.

    NUT UP. This us about your comfort and safety... and common decency.

    Piss on their precious little audit record. It'll be FINE.

    it's limited to a hour or 60 miles on my peoplenet then after it auto switches to drive
