I was hoping this story would sound something like a good beat down on a flip flop fuel island parker. If it was, I and many others here would be happy to pay any legal fees...
It is very possible to get charged with a dui just by opening the driver's door. Being convicted is another thing, but for a cdl just being charged comes with a heap of trouble. Couple months ago a driver I know blew a .05 in his pov and got a dui. He's fighting it, but in the meantime he was fired and is not rehireable.
Have you signed up for AA classes yet ? They keep telling me to sign up for the last 50 years. Still haven’t.
In a lot of states a DUI is if you have control of the vehicle. A lot of courts have interpreted that as having keys in your possession while in the vehicle, even the back seat. Then there is Texas where one got a DUI while working on his boat in the driveway.
This is a non moving / driving ticket, keep it to you. This is no different from beating the wife or robbing a store (which you shouldn’t also do). I’m more concerned with you laying on the ground in a truck stop. Did you burn your clothes? Get a lawyer and beet it and start driving light beer, definitely no more Everclear or Absynth or Jose Cuervo.
The report says that I was asleep on the ground, though, my clothes and skin were spotless, which has me deeply confused. I was blacked out and the first thing I remember is talking to cops so it's hard to reason out exactly what happened though.
Indeed. Blackout drunk me had the good sense to take his keys out of the ignition and get found where there were wasn't any visible alcohol, which is how I think I was somewhat lucky.
I guess the consensus is that I'm fine trying to switch to the new company while the charge is pending since I already passed the background check from the tenstreet application before this happened. That was probably the biggest individual question I had was whether I was safe to do that or not. Im certainly going to be attending some sort of class related to what happened, and fight the charges with a lawyer and try to at least argue it down to I guess disorderly conduct, but just anything that doesn't involve 'alcohol' in the offense.
