Anyone know for sure how this per diem works when filing taxes. My company is paying .04 cents per mile per diem that per day doesn't add up to what the Gov. lets you claim per day when filing. Are you allowed to claim the balance ? say the Co. paid you ( $20 one day the Gov. allows $55 per day, can you claim $35 ) I never had to deal with this before , just trying to get a heads up before filing. I know there's a lot of drivers with the answer to this, Thanks

I don't think you can claime the 80% of $59 if you are taking the companies per deim. Road medic should be along to give a good answer but still advice off the Internet will not keep the IRS off your butt. I have a CPA buts that's me. A local tax prep service may or may not know the rules governing truckers. My CPA does.

Yes you can claim the other part of per diem. If u use a Cpa or turbo tax it'll fill it out as long u let it know your in transportation and under dot hours

Yours is not an easy answer.
You are entitled to 59.00 per day per diem in the US. So, you would need to list the days out to get the figure.
You are receiving .04 per mile per day per diem deduction. You need to calculate the per diem by day.
Example Day 1.
587 mies driven. This shows a deduction of 23.52. You get an additional write off for the day of 35.48.
After you total all of these days, you then post it on the Form 2106 as stated.

That's what I was thinking. If you are not on company per diem, is it $59 a day or $47.20?

You always use the proper per diem amount of 59.00. It must be put on the form, because you then take the limit of 80%.
You are correct on the net result, but using it in the context of the thread would having people put the 47.20 in it and then taking the 80%.blairandgretchen, sal and frankgh Thank this. -
