saved it to my bookmarks and re-copied it. It opens for me and i don't do facebook. It's from the JJ Keller site and I though it might be helpful. Their interpretation seems to fall somewhere between Cowpie and Scalemaster. I hate these wishy washy laws, and this is sure one of them.

It has also come into question what is considered empty. I haul gasoline and fuel, and according to the Wisconsin DOT... I can NEVER be really empty as there are fumes in the trailer... I asked them about it at a scalehouse... My response was: It was my understanding that we merely had to be unlaiden, as I have no BOL that states I am hauling fumes. I went on to say that I have, in the past, hauled chemical where I DID have a BOL for chemical residue... but NEVER for fuel.

The DOT officer looked at me like a deer in a set of headlights and said, "but your still not empty, you have fumes on and cannot use personal conveyance"

It's like they make this stuff up as they go...

 

That was his own personal interpretation.

 

Did you ask him if he was sniffing said fumes?

 

It is called "Residue - Last contained" for a reason. You are "Unladen", yet required to have bills, placards, etc.

 

Hey shred....think about it...what is more "combustible", the residue (or fumes) or the liquid? Plus, your copy of the delivery bills act as the BOL for the return to yard or next rack...verification of "last contained" product.

 

Actually, the "normal work reporting location" is where you NORMALLY report to work, each time you report to work. If that is where you always drop the trailer and then bobtail home, then you might comply with the PC provisions.

Typically the "normal work reporting location" would be your yard or terminal.

 

I run tanker and company policy is PC with a tank is only allowed after the tank has been to a tank wash .

 

So if I'm unladen, then I can use personal conveyance correct... unless, I have a BOL for the fumes... then I'm laden.
