Physical tests

Not company wide, but for my division.

There is almost no discernable disparate impact on women. If you compare the number of females who failed the pws to the total number hired you will find that the female fail rate is lower than the male fail rate. Sample size differences makes this a bad comparison as we get into lies, darn lies, amd statistics, but the underlying truth is there.

Further the 100 pound pull test is not where most people fail - heart rate on the step test and the crouch under test are the big knockouts - neither of which require strength and both of which females are kinestheticly more adept at.

You MIGHT be able to make a case of age discrimination as the over 55 crowd has the highest pws fail rate. But even then you won't win as the test is designed and administered by an outside firm and are demonstrably job related and business neccesary.

 

My company doesn’t require those tests and none of our drivers have difficulties doing our jobs. We also don’t have driver facing cameras, hair drug tests, bi-annual safety meetings, required fuel stops, trucks that won’t idle, or any of the other bs that plagues this industry.

 

And that works for your company. I didn't say the pws is effective, or good policy. I said its not discriminatory and is entirly legal.

 

It shouldn’t be. You work for a company run by jerks. I suggest you find a better company.

 

I almost pulled the thing off the wall at the Phoenix terminal. They got kinda miffed, but I passed, and he said you had to pull 3 times, I only had to pull once .

 

So no company can set minimum, empirically derived, standards?

 

i never do now and for the past 7 years.....we have roll up doors....lol

but seriously, i never really waited all that long for any wind to die down....but then too, i was only a mere 200 pounder myself back in those days of door slamming.

 

It’s discrimination and eventually your company is going to get sued. American workers, especially women, are getting sick of this bs. Inform your bosses and let them know there are plenty of sympathetic men like me eager to serve on a civil suit jury.

 

The only drivers that need to yank on stuff like that are open deck drivers. Sounds lame to me.
