    My question for you is this...

    Are you going to run the load of fresh eggs under the AG Exemption even though your boss has instructed you to run it like a normal load?

    Ag exempt only applies when YOU are hauling YOUR products from point of production to market.
    I’m ag exempt with my log truck.
    I pick up logs at local tree service yards and haul them to my sawmill, where i process them into lumber, then haul that lumber to market.
    The logs are mine upon loading, and the goods are mine headed to market.
    Your example is commercial, given you’re hauling for hire, and not ag exempt.
    Best not to test DOT on it, as they’re not exactly well versed in that exemption most of the time.
    Anytime you are running under it, keep a copy of the rule with you, as often cops haven’t heard of it.
    That alone can and will get you out of a tight spot.

    Agriculture Exemption Diagrams | FMCSA

    According to this FMCSA explanation any time your in the 150 mile radius you are exempt. Going empty to pick up the load or going to market or any where else. As long as no non exempt cargo on truck.

    I hauled a LOT of Cackleberries, mostly from the plant/warehouse to all points midwest, and I never remember it being any different than any other freight. Maybe from the barns to the processing plant is exempt. I went to grocery stores and warehouses. Never a weight issue, 734 cases floor to ceiling on a 48 was never overweight, just handled funky. A word of advice, Humpty Dumpty was on to something,,,an "egg crash" is never pretty, trust me.

    That’s not true at all. There’s a 34 page list of commodities that are or aren’t exempt that anyone can use the 150 mile radius from point of origination.
