This kind of stuff is why I get so angry with the FMCSA and the way they publish their rules. An example of this is going on right now in a facebook group I am a part of. Some are using 395.13 (b) (3) to say a CVSA/MCSAP/DOT certified officer can't issue a ticket for a log book violation.. This section has nothing to do with tickets or fines. It only says an agent can NOT place a driver OOS if these exceptions are present without giving the driver time to correct it. This misinterpretation and the self perpetuating of it has caused more then one roadside argument with these officers and sets up a situation where an officer begins to look for other things to ticket a driver for and then the driver finds himself and his rig OOS. This is just like the pre/post trip discussions that take place all the time. Stupid way the feds write rules.
