    I had a friend that wanted to get back on where I work at. He had worked there from September 2006 to June 2010. When he applied in 2012 hirerite.com found a 1987 DUI that had been “SET ASIDE” because he went to a court ordered class that upon completion the DUI was set aside. Leaving information off of an application is a major reason for disqualifying an applicant.

    I have an arrest for DWI in 1977,

    no conviction.

    it's still on my MVR........

    Mine was in 89 and it does not show up on my record anywhere. Prime did a background check on me several years ago and it did not show up. I live in the state of Va. I am sure different states vary. Checked my DAC report and it had nothing on that.

    I was convicted of BAC 2 times in 2002. My attorney said to me specifically that I DID NOT have any DUI convictions. So if a company asks for DUI convictions I don't put it. Problem is most ask if you have ever had a misdemeanor conviction.

    That may be true but no one seems to be saying what the feds and states require compared to what the company policy is. All companies have the freedom to set their own rules that go beyond the feds and states, a few companies do good detailed background checks and won't hire based on the results - there is absolutely nothing you can do about it, you don't have a right to be hired.

    That's the crazy world we live in now. Make just ONE MISTAKE, and bam you are blackballed for life and society wants you to be homeless and go live under an overpass. Nobody believes in giving second chances anymore. Probably why you see so many mass shootings and guys who go shoot up the mall, society has rejected them won't give them a second chance and they are hopeless without a chance.

    Look into a site called, "Legal Action Center". Expungement & Sealing. It varies by state, but you could get some information there to better inform yourself.

    P.S. to my last post, besides D.W.I.s in the past, also covers drug convictions, you can"t make any of it go away,(Reality check) if you have done any kind of treatment than you know the term "you have to own it", it"s what you do with it that says who you are. "If you work the Program, it will work for you". No one out there is perfect. Yes you made it harder on yourself, so therefor you need to work harder to prove it to yourself,i say self, because you are the one who needs to prove it to you,you do that and it shows,people notice,people as in family, friends, employers.
    It"s not going to be easy, Devils advocate...,would you be a little hesitant to hire someone who broke a law that is related to the job they are asking for? be honest, when you get that face to face, they will sense it, and will probably already know it anyway from the back ground check, that"s when you gotta be a salesman only unlike most of them your not trying to sell them the Brooklyn Bridge(had to use that one aaay i"m from N.Y.) you sell them the person you are now.

    One mistake is simple to solve, getting drunk and driving isn't a mistake.

    You don't know what blackballed or blacklisted is, either. People make mistakes but our society is too far willing to overlook it and let them do what they shouldn't be doing.

    It doesn't matter if they want to find things. There is always a record of it.

    I think the entire idea of expunging a record takes away from the deterrent in the system. What's the use of punishing someone for breaking the law when they can have it removed.
