Preventable accident?

    No it really happened I took it from another place and posted it here. But I changed it from “that guy” to “me”
    So I could argue my side and be more involved in the discussion.

    You don’t like me and that’s fine friendo, but “ruffling feathers” leads to strong discussions. If you don’t take them personally they are great things.

    If you disagree with me that’s fine but can we talk about why?
    I only mentioned the asphalt. I’m arguing on the drivers side here.
    If the asphalt gave way first, is it still his fault?

    Did you do all the damage?

    don’t matter if it is a parking lot or a road, it matters that a truck did the damage.

    a road lifts the liabilities from the driver when this happens, a parking lot is private property.

    Huge difference.

    don’t matter what you think, it matters if the owner of properly reported it for a recovery of cost to repair it.

    I would consider it a preventable incident but unreportable.

    on the other hand I would also fight any claim made against my insurance because it looks like it is a weak foundation.

    Any driver who doesn't understand that the edge of pavement is not made to handle the weight of a commercial vehicle should not be in this industry. It's common sense. Just like not using a church parking lot to turn around. They can't handle the weight.

    Was it preventable. 100% If the owner wanted it repaired. I'd call it an accident. If not. I'd call it a bonehead moment.

    My issue stems from the customer placing an order for a 53’ tractor and trailer knowing the condition of their location.

    So what would you do if you got to a location where there isn’t enough room to back into the dock.
    Say you have to be jack knifed and the edge of the concrete is where one side of the tires will sit?

    the only option I see is like in concrete work informing the customer the driver won’t be responsible for any damages related to the weight of the vehicle.

    More then a few times I’ve sunk a tri axle concrete truck because of the location. 100% of the time recovery costs fall on the contractor.

    That is EXACTLY what I was thinking. Only mentioned the asphalt in the original post, but posted a picture with a "path of destruction" in the lawn. OP.....were you just responsible for the crumbled asphalt, and the damaged grass was already there when you took the photo? I'm a bit confused.
