I disagree about what information previous employers may divulge. If you look closely at most applications, there is usually a small section in the application package stating that you will not hold liable any previous employers for any information or drug test results that they provide.
You are right about the law but this is the way companies get around it....with that little release form that you HAVE TO SIGN.

This is not a true statement, not in Virginia anyway. A previous employer can say whatever they care to about an ex-employee, as long as it is true. But, because they can be held liable for slander most places will only confirm dates of employment and usually whether or not they would rehire. There isn't any law against saying anything else though.

I live in Virginia, and have managed a few businesses....We were told as employees and managers that we can only confirm that they worked for us and whether or not we would rehire! Otherwise, we were open to slander. Since every company had this policy, I can only guess that it is law...

Of course, as a manager, I would be unlikely to hire someone that the other company would not rehire, but some people are mean and spiteful.

Good info here on these posts! As to NOT mentioning an employer in your past employment history, that would be a mistake. DOT regs mandate that you do disclose every job going back 10 years. And, the companies are mandated to verify such said employment.
