The question I was asking, dose the carrier have the right to Monitor all these functions without have it written in contact?

I would assume yes. Their MC #, their rules. They might even make some up as they go along. If you want to find out 100% for sure lawyer up and go to court. You have a choice, quit and run your own company with your own rules. Always amazed at drivers in such antagonist terms with their carrier trying to figure out angles and such. Quit already.

Better yet is the people who have to record phone conversations with their dispatcher or get screen caps of their Qualcom.

As an O/O I go over the speed limit built in on a reg basis. But nothing is said. It's set at 65mph for company drivers so if the speed limit is 70mph, then I will go over sometimes. I guess companies thinks that these critical events are important and just another reason/excuse to rag on you.
I've never been all that impressed with this kind of thing.
It's my truck so I'll do whatever I want. I don't want to be seeing that flashing red triangle either, so I "took care" of that.
With me in the chemical tanker business hauling Hazmat at times, it may surprise you that companies/shippers have insisted that they can access anyone's QComm at any time, anyhow, for whatever. It's written into the contracts when we haul their stuff. So anything coming out of the QComm is to view for all to see.
I've no idea what they hope to achieve by it.
Privacy died a long time ago. Lawyers will have a field day no matter what. That's no different with any industry. I really don't care. No point worrying about it. There's a ton of paranoid people out there that are frightened to death about all these lawsuits and witch hunts.. So anything to get themselves off the hook and blame somebody else, is the name of the game these days. With regard to monitoring it's only going to get worse.
But there's a lot more going on behind the scenes, than you would probably realize. The infamous Walmart crash as changed the landscape in a big way. Lot's of finger pointing going on.
Safety Depts have a very difficult job, and it's 24/7 -
Yeah, they can monitor all sorts of things all they want. I don't even give it a moment of my worry time. I have kicked off the alert thing when bobtail in the rain and a drive wheel locked up on braking. So what. Never heard a word about it from safety. Even if the QC wasn't tattling on you, any truck ECM will have the same thing recorded in the ECM so if there was any question by lawyers and law enforcement, you are still going to be tattled on if they subpoena a ECM dump if there is an accident and such. Like was just stated, the QC is set on over speed alerts for the company trucks. I don't even pay any attention to it. The QC is just passing on the same information that is available in the ECM by anyone who had a motivation to take a look. Some folk's paranoia gland is enlarged and they need to take a chill pill.
