Nope ..no its not a bad joke this is my life for a few months now... and this whole "Sub-Contractor" thing they just sprung on me, because I demanded my pay stubs.

 

Where is this company based out of? And what state are you from?

 

Come work for me... I'll offer you .25 a mile... lots more than you're earning now

If you don't fill out a W2 before you're handed the keys when you start a job run. Run hard run fast.

 

You could call your state employment office and get clarification, or help with the clarification of your status. You can call anonymously with generic details.
When you have the information from the state. Have a conversation with your employer.
With the few details you posted here it looks like he is severely under paying you.

I wouldn't get too wrapped up in the 1099 vs W2 debate. Purely from a looking out for #1 perspective, just make sure you figure your taxes in when figuring out how great you're being paid. Which doesn't seem very great from your posts.

For what it's worth, I pay a percentage on W2. I have an open book policy on that. In fact, drivers routinely book their own loads and always see the rate confirmation. Any driver that asks, is going to see an a/r statement, or actual invoice copies if they want. It's the only way you can pay on a percentage with no questions about the pay. Nothing I'm doing in the office is so top secret that I can't share it with a man I've already entrusted with a $50,000 rig and my safety rating with.

You haven't stated, and may not know, but your employer could be leased on to a carrier (versus being a carrier themselves). In that case, they get a settlement statement on the truck. I don't have experience with that since I am a carrier, but would expect that to be what you should be able to see if that's the case. Depending on the lease terms and how much expense is coming out of it, 25% of that could be really bad and may explain your low pay.

I'm posting all this to let you know that the main thing you need to be concerned with is your employer's apparent unwillingness to back up your pay numbers. If that's the case, you should run and not look back. Anyone worth working for will not have a problem walking you thru the pay statement and showing you where that number comes from.

Exactly.. I should not have to beg for my pay stubs. I should not have to ask if I am an employee or sub contractor after getting my pay stubs. If they own the truck, company name, pay for insurance have DOT and MC numbers.. I don't know... This all started over my not getting pay stubs and then when they do finally give them to me things like Holiday pay (received checks that state this), and other information that does not match up... well one tends to ask questions.
