Rate Confirmation - non owner/operator

    LAW QUESTION: According to this company - before they gave me Rate Confirmations, on some they have blacked out broker information and where load was to be picked up and delivered. On Some they have whited out information. (I started making copies on last few runs) my copies for example have load rate as $1000.00, on the copy they just gave me, they have whited that out. Also almost ALL (I'd say 80% ) of these are not signed by anyone. Is this legal? They are telling me that by LAW they have to do this (black out information) in order to give me copies of the Rate confirmation?

    Join ooida tell them about this company and they will investigate . After they run this company out of biz they can get you the lost wages they have cheated you outof. Hell I pay the $45 myself for you if you promise to follow suite to sue the hell out of them ,what they are doing is illegal and may come back and bite you in as on taxes by swing they paid 1
    &
    $1550 a week instead of 900 then you owe taxes on 1550 instead of 900

    That's bs. They're hiding stuff to make it impossible for you to verify your pay. There are no laws preventing them from providing you credible documentation on what your pay is based on.

    For example, if you worked for me, you would see the unedited rate confirmation without having to ask for it. You would be welcome to come sit with me in the office and review invoices. Never a question about where that gross pay figure came from. Anyone who works on a percentage or commission basis should absolutely be able to reconcile their pay against invoices or equivalent.

    The rate confirmation should be signed. However, especially with a repeat customer, it can be a formality. I have a very short list of customers I will move a truck without it all together. Just get it after the fact. Also, you may have a forwarded copy that hadn't been completed yet. Nothing illegal about it. The signature just formalizes that the terms are agreed to. Although, in context with what you've already posted, it appears just as scammy as everything else.

    Edited to add: There are also no laws requiring them to show you anything. It's up to your common sense not to accept sketchy or no documentation. You may get something out of a civil suit, but better to not even go there in the first place. Too many honest people out there to work for instead.

    I don't know about the law but when I get mine there as they get them. If they are paying % then they SHOULD give you all the info. Mostly the reason I want mine before I roll is for addresses, appointment times, tarps, and special instructions from the broker. I also want to see the actual rate but, the rate doesn't mean anything without the other stuff. A lot of employers want to pay 1099 because they are lazy and cheap and are just trying to reduce there own risk at the expence of someone else. Pitiful! Usually if they are paying 1099 they are taking lots of other shortcuts too. Next thing you know there is a vehicle accident and you find out they don't have insurance. Guess who they are going to blame next!!!! That's right YOU!!! I have worked for people like this in the past that's why I know how to make the system work for me. I have been screwed plenty learning. This defiantly sounds fishy though.

    You know @outonalimb , you could also just go to your employer and tell them what you see wrong and hat they need to fix for you to stay. Sounds like they are new to this. It might be an opportunity to actually make a lot of money if they see that they have someone who is willing to grow with them. Be up front about needing a bigger paycheck and a more honest way of getting paid.

    It looks like they are trying to keep the Facts from you to pay you less. Why are you paying tolls. That is a cost of delivery not your cost as a driver. Well it shouldn't be.

    For the record, 25% pay is standard for employee driver (W-2).
    Independent driver (1099) should get at least 32.5% plus some more if he needs to pay workers comp himself.

    With all the great info for these young rubes on the 'net today it's amazing how many fools are still taken advantage of.

    Fool is kinda stiff of a remark. Naïve, uninformed, those lacking knowledge. Foolish behavior yes, doesn't make them fools.
