I am not a technology guy by any means, and don't know how things can be tracked and discovered. But, What if u had a cheap 'crack' prepaid phone that u paid cash for, and paid cash for the minute cards to keep it going. Use that to talk on when driving. If u have a fended bended or whatever, submit your business phone that you never talk on while driving, and bury the crack phone. You can buy verizon phones for $15, and unlimited nationwide talk/text plans for $50/mo.
When I first started here I was driving with my headset on and saw another pumpkin truck coming. I turned my head so mine wasnt real easy to see, and saw him wearing one as well. Like has been said, yes its a rule, but it isnt a big deal. Dont call dispatch while driving, and dont wear it driving on an sni lot and I doubt you ever hear about it. Last I heard they dont fire you for it, but they might make you go sit in a safety class for a couple days. I use mine quite a bit and never heard about it. I imagine the majority of drivers are in the same boat.
