Sorry, but as a retired federal DOT officer I'm glad you're not in a truck. Most motor carriers worth their salt have gone the extra mile beyond the federal rules simply because you are a serious risk if you were to be in an accident and kill someone while under the influence of that crap. They, and their insurance carriers believe you are a risk and to that I must agree.

It wasn't in a pocket but thrown under the seat. The law has created something called "constructive" possession to get around that inconvenience. If you could reach it or find it, you're in possession.

What no one here understands is i do not do any drugs!!!! I was in a car and i did not know that there was anything illegal in the car!! Yes it was my fault for even being in the car!! Now i am stuck with the bad descision that i made!! I was wondering why i cant get a driving job is it because of the company policy or the dot laws or both??????

If it was DOT you wouldn't have a CDL.
It's hiring preferences where there is no shortage of applicants. -
Well maybe someone might find it ok to give me a chance i hope?? And it will probably have to be a small unknown company,but that is fine i am willing to drive for almost anyone!! And i will make them a good employee!!

Did you protest to the officer that them/there/drugs were NOT yours and you could in fact, prove it, by submitting yourself to a drug test immediately?
Did you see who ditched the drugs there and call them on it?
Did you get an attorney and tell him/her what happened? If so, what did they suggest in your defense?
