Recovery fees

    I was recently working for an O/O who had 4 trucks. I had only been with him about 3 weeks. I was feeling really tired on a CA to OR run. I want going to make the original delivery but he said it was ok and rescheduled for the following day. The next day he told me to park it and rent a car back home as he was flying out and would finish the run. He told me I needed to see a Dr. and not to come back till I had a Dr note on why I was so tired. He then informed me that he was charging me $600 recovery fee and $75 cleaning fee. BTW, I was going to make the reschedule with no problem as I was feeling better already. Can here legally kick me out of the truck and then charge me to get it. Nothing was ever signed upon hiring regarding recovery or cleaning. Every other company I worked for I signed something but there is nothing that I signed with this one. Any insight I thank you in advance.

    Other than getting a lawyer, I I don't see any way to get my money back.

    Actually the owner can legally do this. Your agreement, even if verbally, says, you, the driver will haul the loads AND deliver them on time etc. If you mess up his truck or one of his customers, he can possibly fire you and this could happen out on the road. Is it kosher, probably not. Why were you so tired ? And is this another screwup and bossman said he's had enough ? He has 4 trucks which means he runs a tight ship. Luck to 'ya

    Plus, being an O/O I'm guessing you were on a 1099. If so you have no employee rights as the courts will see it as a business to business relationship. If no contract, then he can charge anything he wants.

    Ah the joys of the covid pandamonia. Good luck driver. Tho in the future you may want to ommit your feelings of tired and what not.

    That's the first time I saw COVID used that way. I will write that down with the 3 or 4 others I have seen.

    I can't shake the feeling the entire story is not being told! This story as told doesn't feel right!

    Yup.......pay a lawyer $1500.00 to try to get $675.00.

    I'm curious to know the reason why you felt so tired after just barely starting to work for this guy?

    Running you to hard? Couldn't sleep well the night before?
