I agree. Had to do that Homeland Security thing when I came back to the road, and their reasoning was Tim McVeigh.

If If this is your first CDL job, you only need Three years employment history, it will be ten after that.
As far as the Govt involvement, there is not a lot anyone can do about that short of amending the Constitution. It sucks, but it is always going to be there. -
That is not what the FMCSA regulations says. You must have a full ten year employment history. In the case of a driver that's say 22 there is no way this guy was working at 12. Common sense tells you this ten year history is not possible for everybody.

The carriers do need the 10 yr history (or equivalent), but are only required to confirm the past 3 yrs.

I know I left the industry back in the 80's returned a few years ago, a lot had changed. The carrier only asked for 3 years employment history. I had worked at that place for 9 years, they never asked about the 10th year.

The operable regulation is 383.35. There is no provision in this regulation mandating company verification of employment history, only that a company MAY verify. This regulation is very specific with no grey area. In fact its so specific FMCSA has issued no Regulatory Guidance on it. The rule IS ten year history. I see no where in 383.35 the phrase three years being mentioned. This is not my opinion or my interpretation. Its right out of 383.35.

Back in 2001 I think it was in February I was sitting in the TA in Duncan SC having dinner. The discussion at that time was of course the election and Florida. A person I assumed was a trucker made an idiotic remark about no time zone crossing Florida. I just sit there looking at him wondering why he would say such an asinine thing that obviously he had no knowledge about. I am now violating something I promised myself I would never do. Something I am not comfortable doing either. But because I get so dang irritated when people with no law degrees or training render opinions I feel the need. People will state FMCSA regulations that either don't exist or down play the ones that do. Last year I traveled with a friend to a town in NC to bail his son out of jail. What peeved me off was the stupid thing this son did to get locked up. I am not at liberty to get into detail but this son is an OTR driver that refused to comply with a lawful request made by a State Officer because he was not (DOT CERTIFIED). I actually bent that son over backward screaming at him for being so fricking stupid by listening to all of those dang truck stop attorneys. My hatred of these morons is so deep now that I actually will not eat anywhere near them.
This forum is used by a lot of new drivers and potential drivers seeking information about trucking and how to handle situations that arise. For the most part the replies are informative and accurate. But sometimes a reply makes me want to throw my coffee cup. The FMCSA regulations are all over the internet there is no reason to be guessing. Please be part of the solution and not the problem! -
Dude (or dudette, as I haven't figured out whether or not your icon is you or your wife), I was in HR - we are required to check a minimum of 3 yrs employment history. Spout the regs as you will - the world still progresses while your wondering how to best comply...
