Restraints while sleeping or riding in bunk.

    Umm....equipment requirement is still applicable for a motor vehicle manufactured on or after July 1, 1971 and equipped with a sleeper berth. There is no provision for a solo operation.

    [FMCSR 393.76 (h)]
    There is no other provision. The supposition on the part of DOT is regardless of intention, it is possible for any CMV equipped with a sleeper berth to become, at some point, a team operation.

    Yes, I may have been in violation, and no, I don't care. I still retained the device in the truck, it was just removed for storage. I never had to discuss the point with any enforcement officer (even having had several complete inspections, including the sleeper area), but I am not concerned about earning a violation over it. YMMV.

    Of course as you posted, if I am not using the compartment as a sleeper berth, then I am in compliance. :biggrin_255:
