Also, as far as stuff hitting the fan goes, I never signed in at testing facility. Was not even asked to do so. No "authorization," no " intake," which, as you may know, is essential, legally speaking, to the testing process.

Well, you can spend $5,000 or more on a lawyer that may or may not resolve your problem or spend $1,000-$1500 on a SAP program and get back to work at Western Express. Only you can make the choice.

That DM don't care if you get the test done or not. He's only the messager. His primary duty is dole out loads. You had already walked out and that's what caused ish to "hit the fan." If you had called and asked somebody, anybody, you probably wouldn't be in that situation. Unfortunately, perception is reality when it comes to drugs and alcohol in trucking. You say the DM has a moral obligation to make sure you got the test done, proper paperwork and such....not really. In trucking, you'll have to cover your own ###.

There are literally THOUSANDS of sources of information on drug testing on the internet, including plain English explanation of the basic rules.
It is COMMON KNOWLEGE that if you enter the testing facility, PRESENT YOURSELF for a test, and LEAVE after that, it is considered a REFUSAL.
IT HAS NOTHING TO DO WITH A SIGN IN SHEET OR WHETHER OR NOT THE COMPANY SET UP THE APPOINTMENT.
I don't see Driver's Manager defined in the FMCSA regulations, or did I miss that?
I CAN NOT FIND where they are the interface to the testing facility, where they have to hold the hand of of the driver to get them to pee.
There are specific manuals for the testing facility and others involved, I would think every driver needs to read them, especially because these testing facilities hire morons to do the intake and test, they screw up a lot and sometimes purposely.Dennixx, Hatt91, ZVar and 1 other person Thank this. -

Yes, not only should truckers be required to know drug and alcohol compliance policy, but it should be required as part of DMV CDL-A testing and CDL-A school graduation, and no, it is not "common knowledge" that if a trucker reports as ordered to a drug testing facility and he is not authorized to take the test and can't get authorization to take the test without "undue delay" that he should not be permitted to reschedule the test.
