    By the way, I think it is telling that in the CFR the term "undue delay" applies only to the trucker, not the trucking company or the service agent.

    But that's just it. I did call, text, and check ELD for "authorization" to take test. ELD said go. I went.

    A lot of things should be in the CDL written test, and more so for the road tests, but it is what it is, made to get as many drivers a cdl no matter if they are morons or not.

    I don't agree, it is common knowledge.

    I don't get the unauthorized stuff, you were told to report to a testing facility, you presented yourself as an employee of the company who sent you and you were told to fill out a form. That is all that is needed to have you fulfill the rest of the regulatory obligation for testing unless you are not telling us other things that are pertinent to the situation.

    I had a driver who pulled this crap a while back, I had to use a specific testing facility for some drivers, the driver would go to any of their locations, fill out the form, and the facility would bill me >>> there was no 'authorization needed' to have the testing done but for some reason, he expected a prefilled form to be presented, constant contact with the safety girl or her assistant and hand-holding to ensure he could piss straight in the cup. When he called me, I told him he needed to grow up, fill the form out, and get back into the truck to make money. He played games for five hours until the place closed and he was booted out. So he was marked as a refusal by the facility and it was reported back to us, which my safety girl told him he was fired and we have a truck recovery executed. He wasted all this time and it was on him, not us or the testing facility.
    Undue delay means you can't make it to the testing facility without reasonable safety. It is on the driver to inform the company that there will be a delay. Once you appear at the testing facility and present yourself, that term does not apply. However, if the facility has problems administering the test, then they can reschedule it and have to contact the company or authority who ordered the test. I had one testing facility contact us about running out of proper wipes to do the tests, they had to reschedule a group of new hires.

    No, sir. I was not told to "fill out a form." I was told by the service agent (receptionist) at testing facility "You need to fill out papers from your employer," to which I replied, "Do you mean papers that you have on hand or ones that I need to get [directly] from my my employer?" to which the service agent replied, and I quote, "From your employer." Remember, this was to have been my first ever "random" drug test in the wild, all new territory for me. I called DM, texted DM to get authorization for test. No answer. Checked ELD. ELD showed a lumber load to go pick up. Somebody, (DM?) put that message on there. I put it together: Receptionist at testing facility says I need papers, I call, text DM, no answer. Check ELD. ELD says go. I went. By the way, insofar as "refusal to test" requires intent, it was never my intention to "refuse" any drug test. Why would I "refuse?" I was there at the place and I was NOT on drugs or alcohol.
    And also by the way, Ridgeline, I really appreciate it, a man in your position as the owner of a trucking company, that you have given me as much of your time as you have. Thanks.

    And also, for what it's worth, I learned this the hard way but I definitely get it now: Next time I get sent to a drug testing facility to take a test, come hell or high water, I'm NOT leaving until my whatever-it-is lands in their cup/test tube and I hear the words "thank you, that's it. Have a nice day."

    There are no exceptions when ordered to take a random. The DMs job is to schedule the test at a specific time. Once you’re told you’re liable to comply. No exceptions. You can’t just postpone it for any reason. Can’t decide to cover a scheduled Load. That’s not your problem. It’s the DMs responsibility. It’s impossible. Same as being expected to pick up a Load with a blown steer tire. Impossible. A call to Safety or any other Supervisor would have an avoided all this. I suspect there’s something missing from this story. I don’t know why Drivers think they can bend the rules on random testing.

    One time I walked into the testing place and saw 10 drivers sitting there waiting. I asked the lady how long the wait was, and she said over an hour. I said Ok, I'll come back another day and started walking towards the door to leave. She started yelling "You can't leave! Once you step inside you have to stay or I'll turn you in!" I turned around and said you don't even know who I am and left...:dontknow:

    Yeah, that's right. And by the way, LOTSO, I'm not trying to convince anyone here of anything, one way or the other. People are free to make up their own minds about what I have to say. Pretty soon I will start a new job and all my musings in his forum will come to an end. I just really appreciate everyone's participation in this discussion because think it's an important topic and like you, probably, I refuse to be a mindless drone.
