Man up and accept responsibility for the actions which left you in this situation.
You were randomly chosen from the consortium or companies internal operations which meets a portion of their obligation. Then you were given notification you had been selected for a random drug screen and assigned a clinic to perform the procedure correct?
You reported for a random urinalysis and didn't take it because you didn't have paperwork from the company or because you were dispatched on a load?
How was this not in your control?
Either way YOU were in violation of the testing protocol.
With several million drivers the rules are standardized.
YOU trained and tested for a CDL license.
YOU accepted employment in an industry which includes random drug testing.
Ignorance of the rules or laws is no excuse.
Did you not enroll or sign up to the clearinghouse? Blaming Western for you not knowing the rules, while it may be true, is not going to help you going forward. We are held to a higher standard when having and using a CDL.
And a company doesn't care if you've failed for a dirty test or for leaving a testing facility, it's all the same on the bottom line.
Reading your posts sounds like you may understand a bit more about the regulations and procedures.
Regarding the statement about pre and post trip inspections I'd tell you despite what any trainer told you, and that despite it being required under federal law, should any incident occur, whether minor or tragic, you can be held personally responsible if it is tied to a equipment failure that would normally be found on a daily inspection.

I’ve seen nobody here accuse you of being on drugs. But you made a poor decision by leaving the testing facility. Whatever the reason and whoever you want to blame it on you made the choice to leave. You keep wanting to blame it on everyone else because the school didn’t tell you this or that or Western Express didn’t tell you this or that. At the end of the day it’s up to you to know the regulations. There is a whole green book of regulations (that is also required to be in your truck) and I can guarantee that your orientation probably only touched on a small percentage of the regulations but it’s still up to you to know the rest.
Yes the clearinghouse system is flawed, but it’s also a lot better than it used to be. It’s unfortunate that there’s a stigma around SAP drivers. And it’s unfortunate that you are a newer driver. And it’s unfortunate that all of this happened right at the time that companies can start being really picky about who they want to hire again.bryan21384 Thanks this. -
