BigDad is correct, you can't be classified as an independent contractor and be under forced dispatch. The driver in question made his home time request weeks in advance, there is no reason for them to not allow him to go home.

And JCT is NOT forced dispatch. And the driver in question made a lot of claims. It may not be forced dispatch, however if you wish to lease from a an individual company it would be wise to be willing to drive into most of the areas they operate. He was with JCT for 6 Months and at least in the beginning he refused to ge east of the Mississippi and other places. He is not the only person to have done this to be sure. Instead my point is if I'm considering working with or for an outfit, it would be wise to figure out what that outfit does and if I'm capable and or willing to work within their system. Not show up and expect their system to be altered for me. As for his issues of not getting home? I can only speak for myself and in 7 years here, I have missed home time by a day or 2 only twice.Alanp613, valkyrie52 and jbizzle Thank this.

it was probably just my dispatcher but I almost never got home on the day I asked for. to be fair I never insisted that I be home that day. on my 25th wedding anniversary I DID insist and was home as scheduled. typically my dispatcher would run me towards florida (my home) and then run me all the way to Cali the week of home time, I never did figure that out..Last edited: Apr 1, 2014

Makes sense ... as long as you drive where the company wants you too, it's not forced dispatch ... gotcha.

But in a way i do agree it is best if your partnering with a carrier to make sure that their corp structure meshs with you and that their business matchs your desires but that dosent mean that you want to participate in everything that they do just that they have what you want....,that sounds convaluded i,m going to bed
Fwiw jct was upfront on their policy it,s not forced dispatch but if you turn down a dispatch you will drop to the bottom of the lisr and prob sit a day.......that was almost verbatum from orientation we are mincing words if you are punished for turning down a load that is forced and that is not how you talk to a o.odrvrtech77 Thanks this. -

Really i.ll check the irs code again didn,t know there were diffrent rules if your equipment is leased financed or owned outright.....nope is what i thought irs dont care

Yes seriously. When you lease a car, can you do whatever you want with it? The answer is no. Can the bank terminate your lease when they see that you're not following their rules? Yes they can.

So i am still looking for you to state wherevin the tax code that it states if you lease equip to an ic(does that make you happy) that you are governed by diffrent tax rules
Remember jct does not lease the equip too you diamond leasing does hence two contracts.....i actually have a purchase contract direct with my carriier for one of my trucks they need not hide behind legal crapola or a shell game because they are following the rules.....you can,t have it both ways either you are an employee or not no middle ground and it sounds like jct is greying that line the more you type
