First, the notice did not come from roadmaster, rather PennDOT. So no reasonable effort was made.
Second, the state has already determined on the record that the school testing procedures were not compliant. It is not an allegation but a fact.
With the new ELDT law, students names will forever be tied to this school specifically and potential employers may view them unfavorably.
Again, I wasn’t looking to argue this case. Just looked for guidance on how to secure my status. That said, this seems like a slam dunk case to me. A very successful law firm with a team of class action specialists believes the same. It will be interesting to see how things play out. I’d bet it all on a settlement. It would be risky to take this before a jury with the state agency already having ruled against you. But I’m often wrong so...

If a student misses the test date for any reason, the license is not suspended, but downgraded to the class it was before the initial test. At that point, said driver must complete the entire process again including permit testing and classroom ELDT theory.

The thing I can’t understand is this.
If DOT has determined that our initial tests were invalid, how can our licenses be valid right now? Does that not imply that some of these drivers are potentially unsafe? How can they allow us to drive until some arbitrary date they’ve set to retest us at their convenience? Shouldn’t we all be grounded until this is resolved? I obviously don’t want that, but it seems risky to preserve the privileges of potentially unsafe drivers. God forbid someone wrecks between now and then and DOT was aware that they should not have been on the road. the flip side is, if DOT says I can drive legally today, why is a future retest or potential revocation necessary or legitimate if I haven’t committed a violation? -

Got a letter from NYS. I have to schedule a retest by 10/6. Lol. They’ll suspend my “D” privileges as well. Sounds like I need to redo all my endorsements as well? I’ll retest and I’ll pass no problem. I’ve been driving since June. The problem is, I have to ask my boss to loan me another truck, for another test and pay a driver to accompany me again. Not sure what they’ll think about that.

Did Roadmaster do your DMV written test and road test and give you a piece of paper to take to the DMV and they hand you a CDL , or did you do both tests at the DMV office.

I did my road test at the school with their in house examiner. All of my other test for my permit and endorsements were done at NY DMV.
