I am a new O/O. I set up my authority to run 30 states, and am getting my plate next week, thought I had all my ducks in a row.
Well, now there's been a little change of plans. Now I am planning to go down to west Texas and run intrastate Texas only UNDER another company's authority. This is also a new start up company and we are trying to figure out together the best way to do this.
I would say I would like to keep my authority and insurance active at least for the first few months, just in case this thing doesn't work out or if I decide to haul an out of state load or something.
I guess from my side of things, I'm guessing I need to make sure I am listed on his insurance, and I put his numbers on my truck, right ? Do I also put his company name on the door ?
Other than being listed on his insurance do I need to be added on with FMCSA or TXDOT or anything ?
Will I keep reporting fuel tax ? I mean, I guess it will be easy to do since I'll be buying and burning it all in TX for the most part.
If I later decide this is going to be a permanent thing then I guess I will look at putting my authority on hold(cancel) an switch my insurance to bobtail, is this correct ?

Get texas authority for yourself and "use" him for brokering. Especially if this is going to just be a short term thing. -
I asked him to consider getting his broker authority, but he said I will be the only O/O he decided after we get started he's only going buy more trucks and hire drivers. We fully anticipate this to last long term, but it's oil related, everybody tells me the oil business can start up and shut down overnight, but right now it looks good for 2+ years.

nothing says you can't do his work on a 1099 as a contract worker.
You still need authority and such under those conditions. You're just doing the paperwork instead of him.
Adjust your rates accordingly. -
hmmm, I assumed he'd need broker authority. So the customer hires him to haul the load, and he can subcontract me to haul the load without broker authority ? I thought that was illegal for some reason ?

check with an accountant or legal type, but I'd say you are a contract employee doing his work.

And you can still run for him with your authority... no broker license needed. My son did this for the outfit I'm leased to and we have a couple more guys doing just that right now... common practice.
But you should be getting almost ALL of the revenue... our guys get 98% of our in-house freight and 92% of brokered loads... but so do I and my authority is on hold. -
Yes you can do this. In most cases to make it legal you will have to have same contract in place with company as he does. But you are using him like a dispatch service. You have less protections if you are contracted and checks go to him and he pays you.
