Remember for you to even be in court there is a charge going to be on the summons. In court it is your word against the cop. The cop might well have did it as @TripleSix said. However once in court YOU the driver failed to obey the instructions. Without some extraordinary evidence to the contrary your going to lose. I also seriously doubt any Attorney will advise you to fight something like this either. Judges are notorious for taking the officers word in court these Attorneys know this too. Blowing past a scale house in some places is a VERY SERIOUS charge that has 4 digit fines.
My company gets green lights everywhere but Florida and ag stations unless absolutely everyone is being pulled in. Personally I’ve been hoping to get an easy level 1 sticker somewhere but that hasn’t been happening for me lol. Got a level 3 hazmat inspection recently which was, of course, clean. Would just add, a Raider Express driver blew that same POE and got dragged back with a DOT pilot for a level one, an OOS order and a huge ### fine. He too said he got a green light on his prepass. Prepass was off. I pull in even if I get no signal at all if there’s any confusion. And if there’s a contradiction, I go with their sign.
