Those #'s are straight off the ILCS (IL Compiles Statutes) website, so they are correct if it is a state ticket. If it is a city or county violation, there could be a different scale. My reply was to @johndeere4020 who didn't seem to think fines that large were possible for "legal" loads. Get on the wrong road, and they most certainly are.

I think it is probably because it was such a small road, it most likely doesn't have good substrate under it to carry a heavy load.

I really don’t want to end my driving career and lose my job over a large fine.... I’ve only been driving for a month...

That's really not a bad scam...spend the absolute bare minimum to put in a low-grade "short cut" to a major industrial area and post it for 5 tons, allowing the local residents and employees to use it. Make the "designated truck route" a long winding round about way of weaving your way into the plant, making sure to pass this short cut early on in the route. Have a cop watch the route, nabbing truckers taking the short cut. Within a couple years, you can upgrade and repave the road without it costing the city/county much at all...paid for by revenues generated by the fines.

Not saying that's what is going on there...just a thought I had.

So how do you determine the amount of overload to base the fine?

    4mer trucker Thanks this.

I would think you could beat that based on the fact that he doesn’t have the actual weight to base it on.

4mer trucker and Ultratowel Thank this.

Depends. You won't beat a speeding ticket by claiming you weren't driving the speed indicated on the citation because you know you were going faster. Likewise, if you know you were loaded to nearly 80K, you probably won't beat a citation for being 60K based on your weight.
