I think you are right about the detention should be paid period. If there is enough evidence about the times, the drivers logs and phone calls. It is due. I thinks the other user who says you should have put this way or that way, is all BS.

CH Robinson is the same way. You'll never see a dime of detention. I even put the times on the bills like they asked. Then they fatten their own pockets.

Interesting subject. I believe MOST of the big companies are looking for ways to increase revenue. About 2-3 years ago it appears they turned their attention on revenue intended for drivers. Then simply set out to see how much they could legally keep from you. Just my opinion.

Also, I think JB is ripping this person off, but did you really expect any other result from JB? I hope you as a company took care of your driver and left the battle as company vs. company.

We are still waiting for our detention pay...it was called in, written on the BOL as stated, but have yet to receive it (3-4 weeks ago now).

The driver got paid when we received the paperwork. It's just amazing to me how a major company can neglect the fact that the driver spent his time waiting and performed flawlessly just to be told that he won't be paid for his work because of a technicality over which the driver had no control. Seriously, if a major shipper hands you a detention form that you're supposed to submit to the broker ALONG with the BOL, would anyone question it?

Very similar to an experience I had getting worker's compensation coverage. In the application there was an area for truck and contract details (in hindsight I probably could have left that information blank as I don't think it really is relevant to the coverage... leastways, the truck information is irrelevant, but once you fill in something...). I was renting the truck from a company I owned (which they can see when they pull up the corporate registry) to myself for a contract which I was fulfilling personally rather than corporately.
I get a phone call from worker's compensation:
WC: We need a copy of the rental contract for the truck.
lNf: I own the truck and I own the company the truck is registered to.
WC: Yes, we can see that on the corporate registry information, but we need a copy of the rental contract.
lNf: Well, there really isn't a "contract" from me to me.
WC: We need a copy of the rental contract for the truck.
<a couple more rounds of "I own it all..." and "we need...">
lNf: Fine, I'll email you a copy of the contract.
<3 minutes to whip up a one-sentence rental contract, sign it, scan it and email it to WC>
New phone call 5 minutes after that:
WC: Your coverage has been approved.
lNf: Thank you.
