I agree somewhat. However, the garbage company is hoping you will do nothing. They have no accountability if no one ever brings legal action. They just rinse and repeat.

An older trucker is guiding me with the paperwork. It needs to be done a certain way or its invalid. Besides that, there has to be law that states 1099 contractor is not responsible for normal wear and tear on a company vehicle.

Also, I didn't agree to 2500, we had an agreement it would be 1500. Come to find out he sent me payroll sheets stating I've made more than what was deposited into my bank.
The owner lied about the amount he was taking out of my paycheck, he sounded very sincere that he would return the deposit if I returned the truck clean and uncrashed. Which was done.

He blocked my number and didn't reply for 6 months. The owner called me recently about 1099 forms, saying he has mine.

Unbelievable that the trucking industry has people that scam other drivers. We're all trying to make money, doesn't mean screwing other people out of their cheese. Why else would we sleep in the truck?

Here is the cold hard facts. The company owner knows full well what they are doing. They stack the deal in their favor. Owner is not stupid, and knows what and how he needs to play the next fool along. So this guy was the next fool in line. Sure, it’s a scam. Here’s the thing, had OP bothered to do a small amount of research, he may have found that it is a slimy company, then at least it was an informed decision to work with them. Could have negotiated something. But no, blindly signed on and went to make money. Yep sure did make money, just not for him. So now the driver is beeeatching about how he’s getting the bad end of the deal. No questions asked, handed the keys to a fairly new truck, and lets make money. Go man go.

    There is no law …

    What does your contract say?

if you don’t have one, file a complaint with the IRS and make the claim about him not paying withholding and claim you were an employee,

You won’t get the money back but you may write it off.
