    Parking on a shoulder is not at all safe, true so i guess its a judgement call to stop on the shoulder or continue to the next exit (if on interstate of course) to find a safer place ?

    I thank you for that! I have the same question about the breakdown situation, though...just nothing out of the ordinary...crap! I got a flat..let's get this thing pulled over and hit the 4 ways...put out the triangles...and call for service. Now, how much hassle do you get? Just a run-of-the-mill flat...?

    If you're runnin' down the road on them and get stopped for an inspection....But not if you have a blowout or a flat and pull over to get it taken care of.

    I got ticket by NY state trooper for blown out tire! Can't find the law that states that's illegal?

    I blew out a tire on a highway a trooper pulled up and said that I had to have commercial plates, dot number, unmarked vehicle and he was gonna give me tickets then he said that I'm doing something illegal and put me in handcuffs. After he put me in his car he started asking dispatch or whoever on the radio if what I was doing was illegal e.g. no commercial plates, unmarked vehicle. His supervisor pulled up and said that I didn't break any laws I don't have to have any of that stuff (I looked up on internet no commercial plates needed if a vehicle's load under 10,000 lbs). A cop got pissed that he couldn't give me tickets for that, so he gave me ticket for having "UNSAFE TIRE". I googled it up nowhere did i find that there is a ticket like that. He then let me go after tow truck pulled up, and took off. Is there a law or a violation says "UNSAFE TIRE" is a ticket?

    I wasn't driving with a blown tire. It was a normal tire, it just blew up and I pulled over as soon as I heard the explosion!

    Unfortunately that IS a something he can fine you for. But, honestly he shouldn't. It was clear from the story this guy was a hard on who was looking for any excuse to arrest somebody. This is exactly the kind of mentality that makes law abiding, smart citizens like me absolutely loathe the police. If this guy didn't have a badge he would probably be out raping people, and breaking into houses
    Asker's Rating:[​IMG]Asker's Comment:this is like getting a ticket for busted windshield after you run into a deer or a bird. I mean why not? Windshield is busted, that's illegal. Who cares there is a deer stuck in the middle of it, next time buy a better windshield or a car.

    Yes it's a ticket, by driving with a tire blown or ready to blow you endanger those driving around you even more so than speeding.

    Now going to court and arguing that you weren't aware it was blown is another matter. It's a fix it ticket, meaning fix it than get it dismissed, you'll still have to pay court costs though. If it's a cheap ticket it may be worth just paying it.

    oh, i agree, but all i am doing is searching things out, is all...........

    frankly, i wouldn't want to mess around with that CSA crap though......

    As a former LEO I have never known anyone getting a ticket for being broke down on the side of the road with a flat.

    well from the time your were a former leo, to now, we have CSA coming on soon........things are changing for us licensed drivers.
