Sent for random drug screening while off duty

Not exactly true. A company can send you to a random drug test at any time, assuming it falls under the actual random requirement. A company can only do an alcohol test while on duty, or right before or after being on duty.

 

When I'm off duty I have no responsibility to answer a work call and never do.

 

You can ONLY be sent for a random legally...when you are just comin in and about to go home etc
Or when reporting for duty
Anything else is bs
Companies jus bein lazy

 

Again, alcohol and drug testing are different. That's true for alcohol but not for drug testing.

§ 382.305 Random testing.
(m) A driver shall only be tested for alcohol while the driver is performing safety-sensitive functions, just before the driver is to perform safety-sensitive functions, or just after the driver has ceased performing such functions.

There is no such restriction for controlled substance (drug) testing.

 

Back in the early 2000's you could just ask them, 'what are you, gay? Don't look at my dick' and they'd leave you alone lol. But in all seriousness, it's pretty weird for them to want to watch to piss in a cup without any previous issue.

 

I got called for a random when I was on the road. Not coming home.

I thought one had 24 hours to comply?

I don't recall ever going on duty.

As for color. Some of us are screwed. I'm lucky to have color these days. Usually it's only the first one in the morning to have color.

 

Why didn't you just log yourself on-duty so you would get paid?

 

Sadly, and I mean REALLY sad, is the industry is going to lose another good driver( I assume they are a good driver) because of this stupid drug testing baloney. This has gone on long enough, and padded a few pockets. Better we should allow drivers like the Hindu guy and run over things, but boy howdy, they pee in a bottle. While this person cut their own throat when they signed ze' papers, deleting all rights, yes, they can come to you on vacation, pee when you get back, an almost guaranteed fail. Who doesn't party on vacation. I'm with the OP, in the words of the late great Tom Petty, "Stand, my ground,,,and I won't back down", and if possible, find something else With the lack of work ethic today, it's a job hunters paradise, and let this industry go down the crapper. It's practically there now, and I didn't want to be a part of it anymore. Can you swing a hammer? Home ( condo) construction is booming, and can make the same money and never have to worry if the phone rings on vacation. Hey,,,there's a reason there are so many trucking jobs, people, and good people, not drug addicts have had enough.

 

I suppose getting a call while off-duty to go take the test can rattle one, but having a CDL means you have been trained on HOS and we share certain responsibility for what we do.
