Why doesn't he open the window 3 inches when he smokes? This way, there wont be a build up of smoke. Secondly, if the guy isn't opening the window he has no respect for the equipment.

Well you have a few options here first I would talk to the other driver and ask him if he can hold his cigarette out of the window when he is smoking it and if he can puff out of the window if possible, explain to him the smoke is bothering you and preventing you from getting a good rest and you don't want to kill you both because of fatigue from his smoking. Second you can try to purchase for him or have him purchase a device that will try to remove the second hand smoke this comes to mind http://www.amazon.com/Smoke-Buddy-P...2?s=home-garden&ie=UTF8&qid=1406044983&sr=1-2, do your research their are many options on the market. Third you can put in writing to your company(kind of a warning letter) accompanied with a doctors note explaining that the second hand smoke is causing you dizziness, lightheadedness(if that is a word), etc while driving,(you could probably also notify dot but this will probably get you fired). Lastly you can check the laws in your state or the states you drive in/thru and file a complaint, some states have smoke free workplace laws, where it is immigrant to have smoke in your workplace.(in this case the truck being your workplace). Anyway good luck let us all know how it turns out, I had a similar situation once myself.

Sue??? Are you ####### kidding me??? This country has gone down hill. Sue because you as a smoker can't handle cigarette smoke. Man up and deal with it or find another job.
