Short paid load.

    I would like some advice on how to handle a short paid load with a signed bol with no exceptions or notations. I moved a new rgn trailer from Wisconsin to Arkansas. I delivered the trailer to a job site. I dropped the trailer with no issues. Exactly 10 days later I receive an email from the broker for a revised rate confirmation with a $425.00 deduction for damages. Included were photocopies of a receipt for fittings and oil, scribbled on the edge was a labor cost. I was never called by the broker. I was told that the receiver tried to catch me as i went out the gate but the truth is I could not get out of the gate for over 10 minutes due to 2 other trucks blocking a small driveway. I was less than 200 feet from the trailer for atleast 10 minutes. The receiver was standing 3 feet and away when I pulled away from the trailer. Their story saying they couldn't catch me is an outright lie. And I dont see how the damage claim is legit either. If the trailer was damaged, if would have been apparent when the hydraulics were used to drop the trailer. Keep in mind it is a self-contained rgn trailer. The broker doesn't want to deal with it , the just short paid the load. I never signed or sent back the revised confirmation. I was waiting for the agent to call me back after he called the customer and told him my story. He never did call me back. Any suggestions or advise from any brokers? Thanks.

    Really stupid question... didn't someone have to sign received when you dropped the trailer?
    Actually have no idea how things are done since i dont drive yet... but i do have a suggestion...get a pocket size digital camera, set it to record the date and time and snap a few pics when you drop off stuff like brand new trailers. Then you'll have time/date proof of condition if you need it.

    I would call the receiver directly and get the story from them or if you can make out the name on the BOL ask the receiver that you need to talk to "Joe" at the construction site. Sounds like a broker trying to get away with something but either way call the receiver, ask for photos, and dig into if this is a legitimate claim or not.

    If you have a signed, clean BOL, file on the brokers bond.

    Simple solution to this problem and from now on. Have all your bills signed NO DAMAGE with a name printed and a signature under it. Best solution to the problem as for the current load with what your dealing with good luck I'd file on the bond and go from there and have a lawyer that knows freight.

    No 1. How can you damage an RGN? No 2. Take pictures! The camera is your best friend. BOLS are just paper, the truth is in pictures. My side, their side, & pictures. Saved me many times.

    I also have had a matter arise in which ATS is trying to short me $800.00. No damage, they are saying it is because I had a partial on the truck and the contract was for "exclusive use". IMO, if the contract was voided their time to renegotiate was before the truck was loaded, not after it was delivered. I hope they come to their senses and pay up, because if they don't it will be my new amount + travel expenses + court costs and I believe the judge will agree with me.

    If your bills are clean and your confirmation is not revised call OOIDA 800-444-5791 and ask for bad broker agent. you will be better off having OOIDA Help you Get your money back from the broker and they know how to do it. And they will do that for free if you are a member if not it will cost you $45 a year

    I agree with the majority. If your bol and pod are clean you can file on their bond.

    I was hoping you would chime in. Ive read some of you posts.
    Also Thanks to everyone else. I have never had to deal with claims or shortages before. I guess in the future I will take some of the suggestions given here to heart. I try to treat eveyone like I want to be treated but I guess not eveybody feels that way.
    .I talked to the broker today after I started this thread. I told him Ihad been waiting since Monday for him to call me back. I also reminded him that I had a clear signed bol. I was very surprised by his reaction- he started cussing at me. He told me not to threaten him and so on. All I said wasplease remember that I have a signed clear bol". I really dont want to but I think it is time to go to the next level as many of you have suggested. Thanks again everybody for your opinions and advise.
