These cases are NOT about what any trucker thinks is fair responsibility. This case, as with all the others similar to it, will be argued before a jury of 99% non-truckers by multimillionaire attorneys. How'd they get that money? They win. They win these cases consistently.
What happens to the truckers found at fault in a court of law? Does it matter?
This is causing massive problems across the industry. The FMCSA is recording all these shoulder parking fatalities as moving truck/auto related crashes. 1/4 of all the stats are skewed thanks to 95% totally unnecessary parking related crashes. These have skyrocketed in last 5 years.
I'm guessing most are by immature, inexperienced drivers tho certainly not all. We have way too much risk as is without all these unforced errors.
It's not worth the risk just to save a few minutes. Shoulder Parking is NO Brainer. Don't do it.
Unfortunately, some simply can't compute risk/reward. It hurts us all.
My opinion(s) are posted here having held a blood soaked mother screaming for her family. I was 1st on scene. The driver just sat in his truck.
I'll never forget the smell, the sounds, the fear. Think about the risk. That's all I'm saying.
