Otr I always took a shower every day, whether I had to pay or use my fuel rewards.

Please explain? If a shipper/receiver holds you up, and your clock runs out, DOT will allow time to get to safe haven, your stuck because you want to be, or your company won't let you, I wouldn't follow that policy, sorry bad example for not taking a shower, I have used this time myself when being held up, even when DOT put you out of service, they must get you to a save haven, food, bathroom, shower, and if it's a 34 hour OOS, even a motel if you want one

well you haven't been to kraft then in morris, il... They now have the drivers sign a piece of paper, and along with the paper you bols. and then you get to back into a dock. If they going to be over your hours the truck stop is right down the road but the shipper refuses to allow you to leave....you can or they will call the cops out for you and the cops tell you that if you leave or try to leave they will arrest you because you already signed the bol, and the other piece of paper.

had a buddy try to get out of kraft, to goto the truckstop to safe haven as he would be out of hours and was forced to stay there till he was loaded, and he must leave the premesis once loaded or they would also site him for trespassing, as once you get the bills from the shipper one's permission to be there has been terminated...

to me this all kinda stupid in my mind but it is what it is i guess, just depends on the cop you get when the problem arises for when one wants to leave and be legal vs leave and not be legal...

Now I have heard the other way too, where officers will put drivers oos at a dock because a shipper/reciever ran the driver out of hours, so not exactly sure if that is myth or fact...but do know that I was picking up an mt once from k-mart and the guard refused to let me leave.

I called the local pd out and explained what was going on pd came out and i pointed out that the trailer was company, truck company nothing in it of kmarts cop had no choice but to tell kmart they had to let me leave.....(again just depends on the cop i guess or the ones who know the regulations at the very least).

I have never been arrested for a simple out of service violation. Haven't heard of it either.

I for one would not sign a separate piece of paper, I sure like to see the police report showing some one was arrest, I have my doubts on that

If I am just waiting for a door, and they won't allow me to leave if I need to, They wouldn't have to call the cops because I'd make the call for them...to report the unlawful restraint.

I understand what you are saying, and again I wasn't there but a buddy of mine was, and he was threaten with being arrested for wanting to leave while the load wasn't ready, (I was on the phone with him when this was going on). 2nd when he told the officer that he would be out of hours when the load was done the officer told him that he would arrest him for trespassing. (which means he had to violate his hours to get to the truckstop). He was in a no win situation with that officer.

but as far as I know and I have personally done on more than one occassion, when I have had a customer tell me they wouldn't let me leave, well I got to leave and they were not happy about it. And have used the unlawful restraint as you quoted in a few states.
