sleeper requirements

    It doesn't have anything to do with enforcing 395 per se, but I agree with @062 on the concept. I have seen DOT officers on the phone with a carrier waiting on a fax or email with a document. A driver can't hide behind 395.11 (g) by getting rid of these documents. The DOT can (and more frequently then you might know) and will seek these documents especially if it has anything to do with mechanical or HOS compliance.

    In the scenario that @Moose1958 posted of a driver having a open account at a hotel. They will call whoever is paying the bill or the hotel itself.

    When I do loads for Whole Foods I am dispatched out of Vernon, CA loaded, deliver to Phoenix, Scottsdale, Glendale, Tucson they put us in a Hotel, I never get paperwork from the hotel it is between the hotel and Lily Transportation. We do these runs in day cabs regularly. I have no proof of anything except my paperlog book (since Im a temp driver not on there elogs). Same with Alan Richie if I need a room they pay the hotel, not me I dont get a copy of the bill. This also goes for UPS/Freight loads I run out of Bakersfield, UPS pays for the Holiday Inn Express across from there yard, I dont get these either.

    I see no difference between these day cabs and a F550 Super Duty Crewcab as far as logging off duty for my 10 hour break, in fact at whole foods I combine my 30 minute requirement at one of the stores with unloading so I am only off duty 8 hour, plus off duty 2 hours at the store.

    You are not required to rest / sleep / be in a sleeper or a motel. You are required to be off duty for a total of 10 consecutive hours, period. Just because a cop ask for it does not mean they have a right to it, oh by the way. They can ask for anything they want, You do not have to make there job easier, you can if you want but you are not required to.
    Just like a dot inspection, you as a driver are not required to operate the vehicle for them to do there inspection, it is certainly the quickest way out of the situation, but if there conducting the inspection its there problem to depress the brakes, turn the wheel and all the rest. Just because they tell you does not make it so.

    I to only have day cabs, and can sleep wherever I want to. And seriously what hotel is handing out paperwork still. Its on an account or a credit card.
    I have not left a hotel or motel with a physical piece of paper in over 5 years. I can sleep on the ground under my truck if I wanted to, or in a tent, or someone's home.
    Unless you are mouthing them off and really get them mad, and then a good reason for revenge, they really don't care where you slept unless it was with their daughter. Many times I have taken my little 1 man pop up tent, and on a 1 night stay slept in a rest area in the tent. Very relaxing and almost like camping. But I am also not a mouthy arrogant jerk that gives them a reason to hate me, and seek revenge.
    I guess they could apply to the court system and subpoena my Visa records if they felt that it was important enough to...but its never happened.

    As long as you DO NOT log "sleeper berth" you dont need a sleeper. Nowhere does it say you have to sleep. It only says you have to be "Off duty" for 10 consecutive hours. WTF you do on your 10 is up to you. You wanna go to the Bunny Ranch and screw hookers for 10 hours then go back on duty that's 100% legal and your decision to make. Probably not the best of decisions about how to spend your 10, but it is yours to make.

    Mind you at the Bunny Ranch you would be in bed, so you can probably ask them for a paper receipt to use as evidence you went to bed...doubtful that they would give you anything though.
