Small accident?

    I'm an owner operator. However if I was a company driver and this happened to me I would tell them to screw off and quit. It's the company's responsibility to pay the deductible for an accident. if they tried to take out of my paycheck I would contact an attorney.

    Couple of things. The damaged truck was an old freightliner with a duct tape all over it. The whole thing is probably worth 7k. The guy just went to a dealership and priced a brand new painted hood, bumper and a headlight. That junky truck can be fixed with $500 and some more duct tape.
    The company is a small 1099 outfit, thats why they want him to pay the deductible. They are alright guys, but I dont think they know how to run a business. My dad is just getting experience there, since its better than work for a mega.
    If company does not report him to DAC, how can other trucking companies find out about this? It will show up when they will try to put him on their insurance policies, is that correct?

    I agree. But the story doesn't add up. The troublesome thing is that when you talk to the insurance company, telling them about an accident in a truck stop, they are going to ask you if the other truck was parked in a legal spot. If this happened while the driver was trying to get on the scale, odds are the other truck was not in a parking spot, and the insurance company will probably refuse to pay and will even tell the other company to go screw themselves.

    Since this incident happened last night, it is doubtful that anyone in the office has contacted the insurance company or anyone in the office that can make decisions was in the office at all...unless, he drives for a really small last chance fleet.

    So gang, this is why you take pictures. If your job is on the line, be sure to CYA as much as you possibly can with pictures.

    Just spoke to my dad. The truck was parked by the scale, not in a designated spot. There are no pictures of the spot though, only pics of the damage. However the cop can probably confirm where it was

    They are NOT alright guys and that company is NOT better than working for a mega. Some mega carriers are OK and some aren't. Those guys are throwing your father under the bus for a few dollars. Time to move on and find another company; several legal and professionally run companies will hire him.

    It's time to ask a question on the "Questions From New Drivers" thread; "I hit a truck in a truck stop and now looking for a new job; what companies will hire me? Can you drivers help me find another job? I live in Warren, Michigan."

    Don't be so sure the company doesn't report him to DAC.They may be angry enough and subscribe to the service just for that reason.A small company I drove for did.But my lawyer got all his garbage removed as part of the settlement when I sued him.

    I would tell the company to stick it and if they fire me, I would just collect unemployment.

    Yes I would file for unemployment even if I was an 1099 because they are making the claim of employment not contractor when they are telling me I needs to pay for deductible - I am assuming there is no contract, which makes me an employee now.

    See IF the truck wasn't properly parked then it isn't really the problem of the driver, which means that the insurance company needs to step up and fight any claim. The owner of the t/s also needs to make sure those scales are clear of obstacles for entry and exit of the scale, if it is a cat scale, I think that's written in the franchise agreement so it may be a case that the insurance company and the carrier needs to address recovering the costs with the property owner not ding the driver.

    By the way where did this happen?

    Tnere has been a lot good responses... and this one from China should be considered fully..

    For newbies the right big or mega can help get a solid foundation in this career and industry. .. and as newbies there is so much we dont know and understand about things that it is too easy to get taken advantage of with some small companies. .. and yes large and mega ones too... but, at least with a good large company we are not in over our heades....

    I know as rookies it is hard to admit how green we are... even if we drive good and othefs marvel at our skills... we do not have the knowledge and understanding of this industry that only time and experience bring...

    At werner they give us disposable cameras and tell us to use it all up taking pictures of everything... I have seen drivers use up two cameras taking pictures at every angle and everthing and anything around the truck... and when the accident review was done the it helped the driver... cause as stated another truck parked where it shouldn't of been... the pictures geave the insurance company and lawyers what they needed to fignt it...

    Sorry this happened to your dad.. please take in the good responses and help offered here...
