lawsuit? this is false PA labor laws do not allow you to sue your employer in this situation.....they offered you light duty work which if you knew anything about the law you would know that you HAVE TO take any work offered to you in the state of PA ever since PA did away with this "blue laws" its been a employer run world out here......if they offer you hours or a position you have no choice you have to accept the work....only thing they cant do is force you to break "biblical laws" such as working on holy days........sorry but this is a lie........

This is not the first time I've heard this.Several that have been injured have spoken about being offered work at Smith while on Workman's Comp. I also believe I have heard (and read) of lawsuits against Smith. Though they're not spoken of very often. It's usually kept very quiet.
Also, the miles for OTR are down. Lots of short hauls 100-200 mile trips plus new trainees. One class was approx. 30 people. Miles have to go somewhere. If you work for Smith, you know how that works. One great week, one really bad week and 2 that are so-so. But it seems like its a little better than what it was about a year ago.

From what I heard, USX is part owner of Smith. Not sure how true it is but it's been mentioned on several different occasions.

They used to have part ownership, something like 48%. It is my understanding that Barry has bought that back. If they have anything it is very minimal. From what I understand most (if not all) of Smith trailers are no longer parked in US Ex yards. As far as the ad goes, if you come to this site and not log in it is there.

Well I currently work at Smith and we still use and/or share yards to t call loads and drop loads all the time. In fact just about all US express yards have Smith trailers and I work out of Atlanta and we share a yard with them in Ellenwood. But u are correct tht US Exp have very minimal control in Smith.

That is incorrect...I can understand how you would assume that those trucks are idle ,,,,As an employee I thought the same thing until I was switched to the dedicated fleet(Quaker Oats/Gatorade). All the trucks you see parked are local, regional and dedicated regional. Smith uses older OTR trucks for city /local wrk.(mostly 379Petes) The 6/7 local drives usually work from 7am to 5pm and after their shift they parked their tractors in the back corner of the yard. Smith also has 10 trucks on regional dedicated and they are home nightly as well they cover all loads outside 100 mile radius of Atlanta. I work dedicated shuttle and I shuttle between the Gatorade warehouses and supply raw materials such as pallets, empty bottle, etc.... We are the only ones that uses day cabs in Atlanta. We have 16 drivers on four shifts wrkn a four on four off schedule in 12hr shifts

This was last Friday morning and the lot was packed on one side with smith tractors and trailers two and three deep. Some USX tractors and trailers but most of those were moving in and out of the yard. Thanks for the answers.
