There's more we need to know here. What did he give you a warning for? Was it speeding? Are you sure he was a cop? I'll tell you if it were me number one I wouldn't stop unless he was stopping me. Second, I'd take some pictures of the speed limit if he wrote for under 70mph. Are you sure there were no speed limit signs just for trucks? See there's a lot to know here for any real suggestions. Otherwise, all we can say is be careful and watch out from now on.

So you got a warning for going 67 in a 70?.

He got pulled by a Texas HP on a 70 mph 2 lane. Cop pulls him over for "speeding", does a quick inspection and writes him a warning for speeding. Now he has CSA points against him and he did nothing wrong. It's complete and utter BS. There is no greater injustice in this country right now than this CSA crap.
If this was happening to the general public, everyone would be outraged. If he were black or gay or a woman, he could probably find some social group to champion his cause and get some media attention, but as it stands right now, there's absolutely nothing that he can do.
Whenever I go into a truckstop and see those TVC people, and drivers talking to them, signing up for the stuff, I want to tell those drivers that TVC and PPL and any of that lawyer stuff is completely useless. I don't mean to sound political, but certain democrats had a hard on against truckers, and when they got their boy into office, they got their agenda passed. No one was paying attention.
Worse thing is, certain "drivers" always have something negative to say about the people who try to avoid the DOT checkpoints. All Opie has to do now is get put OOS for brakes and not come to a complete stop at a stop sign and he's history because he will have too high a score and will be deemed a bad driver.Last edited: Oct 30, 2015

If the officer issued a state MCSAP inspection form and the speeding was listed on it, its going to be placed in your file. It stinks but it is what it is. It should not effect your insurance and provided your record is clean not cause you any problems. Just try to not get anymore.

Ok, I understand now but since I'm retired there's little I can do or I would do it. I would hope that this site is seen by more and more everyday and the drivers start to realize that a driver has enough pressure now and doesn't need to worry about some idiot in power that does not have a clue. It would be different if the inspecting officer knew what he was doing and could back it up with a ref. number. At least then the driver might have a chance to fight it if the officer was wrong. Simply saying the brakes were out of adjustment does no one any good. Except the courts have no idea either on CMV's and can only go by what they read and how much time they put into researching the infraction. And we all know that's about a minute or so. So we have a system install to where the law and courts seem to think it's great and working but in reality it's not helping safety but it make the LEO's look like they are doing above and beyond.
So, what I can do to help is learn all I can about the system and speak out. Sorry I couldn't do more.jowada Thanks this. -
Well, see...thats the thing. There is no 'courts' involved because it was just a warning. The warning cuts the courts out, cuts out pleading your case before a judge, or anything. He gets penalty points automatically. If he were speeding, he should have received a citation and points. He wasn't speeding, did not receive a citation, but receives points against his safety record. There is no due process, there is no appeal, no legal safeguards, there is nothing set in place to protect drivers.
You can run perfectly, never get a citation, never have a crash and get enough points to put you out of work. That's how the CSA works. He would have had a better chance if he actually was speeding. At least that way, he could get the courts involved and plead his case. -
Well, usually they don't put speed limit signs up very frequently other then where the speed limit changed, and the fact that there was a speed limit sign at the location he pulled over, tells me the speed limit had recently changed up to 70 from something lower ... or had been 70 for some time and he just so happened to stop in front of another speed limit sign they put up every 15 miles or so. Anything is possible, but I'm not prepared to accept he was inside a 70 MPH zone at the time of the intercept. But I don't think you can receive a warning for speeding, without a speed limit and a speed accusation both being noted, and something tells me the warning did not say "68 in a 70".
But if the cop wanted to do a quick check on a trucker, they are able to do so, and they don't have to have a reason such as alleged speeding. -
oh yes they DO have to have a reason to pull you over. but the sad part is they can make up any reason for pulling you over. I refuse to take a warning on a dot inspection after csa was started. I never argued with dot on violations before this. but now I will argue to the bitter end if dot is in the wrong, period! it is sad how you have to almost have an attorney on retainer now a days for this crap! a video recording with audio is a must when this happens now!
