Splitting your clock

    Just so you know, you will be in violation for busting your 14 on Friday. The 34 reset, or for that matter even a 10 hour break doesn't matter. You not in violation on Monday.

    That means I am in violation for busting my 14 every Friday since we started running under the new HOS rules.

    Well yes. Just because you only got caught once doesn't mean that's the only time you were in violation.

    Look, again, I'm not saying it's righ, it just is.

    I wish we had some law enforcement or attorneys chime in on here, on the interpretation of the law

    What is there to interpret? It's very black and white. For a split to be valid a sleeper period of at least 7 hours is required.

    Nothing to interpret? I would not be so sure, as it applies to the 34 hour break. I’ve had this conversation with others in the logs department that evening, including the supervisor, who actually told me there was nothing wrong with my logs. I think this might have actually started a bit of a fuss in the logs department, and it depends on who you get.

    I learned two things.

    1. Don’t take advice regarding HOS on the internet. Some of y’all would have me falsify my logs before I go home, then come back and falsify them again by editing them when I get back to the truck.

    Even if you really did it, no state trooper would believe you spend all your 34 hour breaks entirely in the sleeper. Nor would they believe you didn’t falsify your logs if you split your clock into your 34 and edit them every time you return. Any edit is a red flag especially a pattern of editing in your logs! Track your HOS in real time!

    2. I gotta stop splitting my clock into my 34 or take my tractor home every weekend and get a rider policy for CYA. Because I am not spending the first night at the truck stop going into my 34. If I can’t even get a consistent answer from logs on that it’s better to err on the side of caution.

    Now tell me this:

    If I go on duty while I am chilling in the sleeper to prevent splitting my clock, because I am going home for my 34 when I get empty, and I don’t want to spend the night in my truck- is that illegal?

    As I've already posted the regs that show a 7 hour sleeper is required to make a valid split sleeper, mind showing the regulation that provides a 34 is an exemption?
    Also just because he's a supervisor (or dot officer, or compliance officer, etc) doesn't mean he's not just repeating bad information.

    Why are you going on duty? A split sleeper is 100% optional.
    Might want to actually read the regulation that was posted, you will notice the word "may" in there.
