I drive in Texas, New Mexico, Arizona, and California, and no one has ever asked me for my passport. Heck, I only have a passport because I took my Mom to Ireland 20 years ago (note to self: it’s expired, look into renewing it!).

I’d be very surprised if even 5% of the drivers on the road who are US citizens have a passport.

And probably nobody actually carrying it. Unless they have a load that crosses the border.

This is true, just like you can take videos of the local police station from the sidewalk; all PERFECTLY LEGAL. And, the next time a cop asks you for ID even though no crime has been committed, you are free to refuse him. Expect a certain amount of your time to be wasted in convincing him of that fact; maybe a few minutes, maybe not until arraignment in front of the judge after a weekend spent in the hoosegow......

Well at least if they arrest you unlawfully you're in for a pretty big payday with any constitutional lawyer which will usually work on contingency.

They ask if you are a citizen. They don't ask for your papers.

Legally there's no difference if they require an answer.

You have to read more about it, the ACLU can give you a lot of details, but this is just a cut sheet for you to see the overview.

I do not agree with the 100-mile law, and I have asked for my reps to introduce a repeal of it. In my state, they use the BP for a search of a car pulled over by state or local police; this is abuse. This also happens when they execute a search warrant in Detroit; they are allowed to do things that locals are not allowed.

I am very aware of the ACLU's position and agree with it to a point, being a membership organization, the problem is when they refuse to come to the aid of their members who have had issues with BP, they select cases for invaders and non-citizens over those of US citizens and legal residence.

The 4th doesn't make allowances for being left alone while traveling. There are situations that allow law enforcement to ask who you are, and this was addressed in some parts by the 14th Amendment but not fully until the courts were involved later in the 1960s.

Oh and another thing, I can't board a flight to go anywhere without special ID, that's a violation of the 4th amendment,

Woman who allegedly snuck onto Delta flight arrested again at airport
We don't need no stinking ID.
TSA is a bad point because it's always been bad and security theater.
For a cup to get your ID you need to have been suspected of a crime. It is reasonable articulable suspicion. Even in stop and ID States they need a crime suspected before authorized to demand your ID.

Don't get me started on the TSA, never has there been a useless agency as the TSA.

If you run a stop sign, and you get pulled over, is this a crime?

    Bean Jr. Thanks this.
