I have a Misdemeanor from 6 years ago. I was parked in my driveway after work and had to go in garage to get snow shovel so I could get inside my garage (Plow pushed snow up against garage and could not climb over). When I was getting gloves and shovel, I heard the beep of a truck backing and walked out to see a notorious towing company truck trying to back up under my vehicle to make a quick $125. I ran out with shovel in hand and stood between his truck and my car, but he backed in to me knocking me over. He pulled up about 15 feet and I got up and started SCREAMING at the jerk. He never got out of his tow truck, not once. He proceeded to call the cops and I shoveled my way in to the garage. After I got the car inside, I went in to put a bandage on my knee where I hurt it when I fell and the cops were knocking on my door. They told me I was being taken to the station to be booked. When I got there, one of the cops told me they were investigating the tow company for towing cars legally parked, but I was charged. I hired a lawyer ($4000) to fight, but he was a fee to plea guy and I did not know that. He said I could accept the aggravated assault (Misdemeanor) or pay him another $4000 and he would fight it, but there was no guarantee I would get off and the charges would be ramped up to a felony. I was broke from the original $4000 so I took the misdemeanor. Big mistake, I should have fought it. This was over 5 years ago and I want to drive OTR. What are my chances? I have NEVER had an accident, and no speeders for over 7 years. Also, I am 49 years old. I drove a 26' box truck for 6 years in Chicago and a Limousine for 5 years in Chicago. No accidents as I said. What are my chances? If I should have posted a new thread, my apologies. I just thought this one matched my situation somewhat. Any of your thoughts would be appreciated.

Most OTR places are 5 to 7 years in the past with a clean record since... you should be good to go. You should understand there is plenty of piciune BS in our lives as drivers that you are going to need to deal with daily. Getting in a beef with the cops as a driver will get you terminated fast.

I would have also demanded a jury trial for the charge, your right to do so.Teddy_Salad Thanks this. -
I am in a similar situation having a felony background, however I have 5 felonies in my background. The good news is they are 14 years old and are not sex, drugs, or violence related. Am I hire able?

Did anything work out for you? My husband is 1/2 through school with a misdemeanor larceny less then a year ago (long story but I swear he didn't do it, just crappy situation). We were assured it would not be a problem but after getting two no's from co. (One without reason, the other the Canada issue) I'm getting a bit concerned. He had two call and say they will review the app/call when done, When he graduates but I don't know if that means they haven't looked at it or what. Thanks.

I could be wrong, but if I were a convicted felon who with a new CDL, and was free to travel, I'd go to the North Dakota oilfield and knock on doors. I bet they'd give someone a chance if they presented themselves as a clean, honest, and mentally stable hard worker. Especially now that it's getting cold and workers may be scarce.
