So, something that popped in my head with people talking about 1099s. If a single OTR driver, has no "residence." How does the company calculate if they should deduct state income tax withholding? So as an example. Right now I live in FL, but plan to really home base out of OK. My Fiance WILL reside there. But for the time being I won't be listed on any leases...etc. What's likely to happen in this instance?

Easy.
Your CDL A lists a residence. THAT will be your tax state.
No residence? no CDL. -
Ah so if I use my current residence, which is FL, and just keep renewing it. It will stay FL, at least till I get a residence somewhere else. Technically I could always doe like my nephew and just use my mom's house. At least while she's still with us.

No.
Your CDL Follows you wherever you stay or go.
FL? Cool. If you MOVE somewhere else? That state requires you to surrender FL and get new state's CDL with THAT new residence in 30 days time limit.
Do not try to ... cheat or ghost using a hidden residence. -
right, but I won't actually be having a residency. As I'll be mostly living outa the truck...etc.
-
You said you are a 1099 driver? You must have a legal residence in order to claim the per diem deduction. I not saying you have to actually live there.
-
Um no, never said I was a 1099 Driver. I think you might be mistaking me for the OP of that other thread. I am going to be straight company driver.
